Purpose
This document aims to outline the terms and conditions of registering with ThirteenTen Talent (‘Agency’). All artistes or parents/guardians of artistes must read, understand and accept these conditions before completing the registration process. It is understood that by completing your registration, you accept the following terms and conditions.
Application Process
Applicants or the parent/guardian of the applicant will complete an online form to express interest.
The Agency will consider all applications received and successful applicants will be contacted directly and invited to meet with the Agency team at a registration day or virtually.
If a response has not been received within 4 weeks of submission, unfortunately your application has not been successful. Unsuccessful applicants may reapply in the future.
The Agency accepts registrations from artistes from all backgrounds, abilities, racial or ethnic origins, religious beliefs and sexual identities.
Representation
The offer of representation by the Agency is attached to these Terms of Business and shall remain valid for acceptance. The offer of representation is for TV, Film, Voiceover, Theatre and Photographic work. Artistes and parents/guardians may inform the Agency if they only wish to be considered for work in specific genres.
The Agency will always operate as an employment agency in accordance with the Employment Agencies Act 1973 and The Conduct of Employment Agencies and Employment Businesses Regulations 2003. We are a non-sole agency, therefore artistes can be registered with other agencies. Any prospective artistes currently contracted to another non-sole agency must detail this within their application.
Our database is hosted by Tagmin and a profile will be created for all successful artistes. We ask that artistes and/or parents/guardians to keep their profiles regularly updated with unavailable dates, appearance changes, etc.
We recommend for all artistes aged 4 years and over to be signed up to Spotlight Casting Directory. The current cost for this (correct as of May 2024) is £121.20 per year for children and £165 + VAT per year for adults, although costs may increase annually. There is a 50% discount on these costs for those with disabilities. Whilst joining Spotlight is not compulsory for Agency artistes, Spotlight provides artistes will additional opportunities for professional work.
Photographs
All artistes must supply a headshot and full-length body shot. The photographs must be of high-quality and taken against a plain background with good lighting. Photos must be a current likeness and not contain any other persons. Photos must be updated regularly to account for any appearance changes. The Agency reserves the right to refuse any images that do not meet the specified criteria.
We offer an optional in-house photography service at registration days and update days throughout the year. There is a charge for this service which currently starts at £25, although costs may increase annually. You will receive digital copies of the images taken. All image rights are retained by the Agency.
Artistes and parents/guardians will be asked if they consent to the Agency publicising images and/or videos of the artiste on the Agency website and/or related social media pages. Consent can be withdrawn in writing to the Agency.
Bookings
The Agency is unable to guarantee castings or bookings of any kind for any artistes.
The Agency will make suggestions of suitable artistes that fit the specific brief requested by production companies and casting directors. All briefs contain detailed requests such as age, height or clothes size, therefore artistes and parents/guardians must ensure that this information is correct and updated regularly.
If an artiste is shortlisted, we will provide further information regarding the next stages of the casting process. Artistes are under no obligation to accept any castings or bookings offered. This will not reduce an artiste’s opportunities in the future.
Castings can often have a short turn-around time. We would expect artistes or parents/guardians to respond to any requests as soon as possible. This includes requests for self-tapes, specific information related to the brief and confirmations of availability. Please note, it is the responsibility of the artiste or the parent/guardian to respond to requests. The Agency does not take any responsibility for missed castings or requests.
All bookings will be confirmed in writing, via email and need to be accepted by an artiste or parent/guardian. Artistes or parents/guardians may receive a contract from production to be returned as quickly as possible to the Agency. Not returning the contract will not invalidate the booking or acceptance of these terms. All artistes are expected to honour confirmed bookings. Non-attendance at a confirmed booking, without prior notice, will result in termination of the contract.
Productions retain the right to cancel or amend any booking. Should this happen, you will be contacted and informed by the Agency as soon as possible. Alternative dates and or locations may or may not be offered. The Agency will not be held liable for such changes.
All bookings involving children will remain provisional until a Child Performance Licence has been issued by the relevant local authority. It is imperative that, during this time, children remain available for the required booking dates, unless exceptional circumstances arise.
A Child Performance Licence is required by law for any child taking part in paid performance work. This is compulsory for all children from birth until they reach compulsory school leaving age. In England, this is the last Friday in June of the school year when the child reaches the age of 16 and finishes Year 11 at school. A child cannot perform without a valid Child Performance Licence in place, therefore any provisional bookings will be cancelled if a valid Child Performance Licence is not issued. This can take up to 21 days to process, therefore it is necessary that parents/guardians complete Part 2 of the Child Performance Licence Application as soon as possible.
The necessary documentation for this includes:
· Completed Parts 1 and 2 of the Application
· Two identical photos of the child
· Copy of the child’s birth certificate
· Permission of absence letter from the child’s school.
It is the parent/guardian’s responsibility to ensure that they have requested leave from the child’s school if the child will be missing school for a confirmed booking.
Fees
There are no upfront charges to join the Agency. In addition, there are also no administration or media/platform charges.
All work offered to artistes is paid, however there are no set fees for roles. The Agency will negotiate with productions on your behalf and will advise artistes or parents/guardians of the rates of pay at the stage of offering work. This will also be notified in writing when the role is confirmed.
All work secured through the Agency is subject to commission. The commission rate is 15% commission on all work, except Theatre (10% commission). Commission is payable on all daily rates and usage fees. Any buyouts, royalties or any further monies accrued from the original engagement are also subject to the above commission rates. Commission is not taken from expenses payments such as travel allowances, per diems, etc.
The agency reserves the right to change the fee structure at any time. This will be clearly communicated to all artistes in advance of any changes.
Payments
The artiste or parent/guardian of the artiste agrees that the Agency will receive all fees for their bookings on their behalf.
Payments for work completed will be paid to artistes within 10 days of the Agency receiving it. Payment statements will be emailed to the e-mail address stated within the application, detailing the commission taken from the completed booking. It can take approximately 8-12 weeks to receive payments from productions, however in some cases, can take longer. The Agency can only pay artistes for work once payment has been received from a production.
The Agency is unable to accept responsibility for payments. Whilst we endeavour to retrieve monies owed from productions, the Agency is not liable for any payments that have not been received.
All artistes of compulsory school leaving age or older who complete work through the Agency must be registered as self-employed and are responsible for their own tax. Children are not subject to National Insurance but tax is due on any payments if the total income is greater than the individual’s Personal Allowance.
Confidentiality
It is imperative that artistes and parents/guardians adhere to the strict confidentiality rules surrounding the productions worked on.
By registering with the Agency, you agree that you will not:
· Divulge or communicate any confidential information which relates to the casting process of booking for a production of any kind. This includes family and friends. Confidential information includes scripts, cast information or any events that occur on the day(s) of work.
This is not an exhaustive list.
· Take photos or videos whilst on set.
· Post or share information relating to the production on social media.
The Agency expects artistes and parents/guardians to represent the Agency in a professional manner at all times. Failure to adhere to these terms will result in Agency contract termination.
Data Protection
The artiste or parents/guardian consent to the Agency holding and processing data relating to them for legal, personnel, administrative and management purposes and in particular to the processing of any ‘sensitive personal data’ as defined in the Data Protection Act 1988 relation to them including as appropriate:
· Information about their physical or mental health and condition to take decision as to their fitness for work;
· Their racial or ethnic origin or religious or similar beliefs to monitor compliance with equal opportunities legislation;
· Information relating to any criminal proceedings in which they have been involved for insurance purposes and to comply with legal requirements and obligations to third parties, and;
· Information relating to their age, race, sex and physical appearance required to judge their suitability for specific roles.
The artiste and parents/guardians consent to the Agency making such available information to a production company, regulatory authorities and governmental organisations, in addition to the transfer of such information outside the European Economic Union for purposes connected with the performance of these Terms.

Termination
Artistes or parents/guardians can terminate the contract with the Agency at any time by the giving of no less than four weeks notice. Notice must be written and sent either by email or letter.
Notice will not be accepted via telephone.
Any work that falls within the notice period will be subject to the standard Agency commission rate. Further work for the same production at any time will be subject to the standard Agency commission rate. Any active submissions, meetings or pending offers during the notice period will remain with the Agency, and if successful, will also be subjected to the standard Agency commission rate.
The Agency reserves the right to terminate the contract of any artiste at any time without notice.
Revisions to Terms and Conditions
The Agency reserves the right to amend the Terms and Conditions at any time.
